These Terms apply to orders placed by consumers on the website vincereart.fr.

2. PURPOSE AND ACCEPTANCE OF THE TERMS

These Terms define the rights and obligations of the seller and the customer in connection with the online sale of the products offered on vincereart.fr, including artworks, prints and artistic editions sold under the name VINCERE. Placing an order implies the customer's full and unreserved acceptance of these Terms.

The applicable Terms are those in force on the date of the order.

3. PRODUCTS

The essential characteristics of each product are presented on its product page: type of product, dimensions, materials or medium, finish, price, any limit on the number of copies and, where applicable, pre-order status. Photographs and visuals are intended to represent the products as faithfully as possible. Slight variations in colour may nevertheless occur due to screen settings, printing processes or the specific characteristics of the media used.

When a product is presented as a reproduction or print of an original artwork, the product sold is a printed reproduction of that artwork. It does not contain the materials that make up the original artwork, unless expressly stated otherwise on its product page.

When a print is offered in several versions, for example Standard and Premium, the specific characteristics of each version are stated on the product page before the order is placed.

4. PRE-ORDERS

Some products may be offered for pre-order, in particular when they are put on sale before they are produced or immediately available. Pre-order status is clearly indicated on the product page. The customer pays the price of the order when it is confirmed, in the same way as for a standard order.

The product page indicates an estimated shipping date or period. The customer therefore acknowledges, before ordering, that the product will not be shipped immediately. In the event of a significant change to the announced timeframe, the seller will inform the customer as soon as possible.

Offering a product for pre-order does not remove any of the consumer's statutory rights, in particular the right of withdrawal where applicable.

5. PRICES

The applicable prices are those displayed on the website at the time the order is confirmed. For French consumers, prices are displayed in euros, including all taxes (VAT included) where VAT applies.

Any delivery costs are shown separately before the order is finally confirmed. For international sales, applicable taxes may vary depending on the destination country and the regulations in force. The amount actually charged is shown to the customer before the order is confirmed.

For shipments outside the European Union, where import taxes, customs duties or clearance fees are not collected at the time of the order, they may be charged to the recipient by the authorities or the carrier in the destination country.

6. ORDERS

The customer selects the product and, where applicable, its variant, finish or size. Before final confirmation, the customer can review the contents of their cart, the selected products, their price, the delivery costs and their contact details. It is the customer's responsibility to check the accuracy of the information provided, in particular their email address and delivery address.

Final confirmation of the order creates an obligation to pay. An order confirmation is sent to the email address provided by the customer. The seller reserves the right to refuse or cancel an order, in particular in the event of non-payment, suspected fraud or an obvious error regarding the availability or price of a product.

7. PAYMENT

Payment is due in full at the time of the order, including for pre-orders. The available payment methods are those offered during checkout.

Transactions may be processed by secure external payment providers. The seller does not have access to the customer's full banking details when these are processed directly by the payment provider.

An order is only considered confirmed once payment has been confirmed.

8. DELIVERY

Products are delivered to the countries offered during checkout. Delivery costs are calculated based on factors including the destination and are communicated to the customer before payment.

For products available for pre-order, the timeframe or period indicated on the product page corresponds to the planned shipping period. Once shipped, the transit time depends on the destination and the carrier used.

When tracking is available, the tracking information is sent to the customer. The customer is responsible for the accuracy of the address provided. If a parcel is returned due to an incorrect or incomplete address entered by the customer, any costs related to reshipping may be charged to the customer, subject to applicable legal provisions.

9. INTERNATIONAL DELIVERIES

For orders shipped outside the European Union, customs and tax formalities vary depending on the destination country.

Customs duties, import taxes, administrative fees or clearance fees may be applied in accordance with local regulations. When these amounts are not collected at the time of the order, they remain the responsibility of the recipient. The seller has no control over their amount or any delays caused by customs procedures.

10. COMMERCIAL RETURNS AND EXCHANGES

VINCERE does not offer returns or exchanges on a commercial basis, in particular for a simple change of mind outside the rights provided by law.

However, this commercial policy does not limit any of the mandatory rights the consumer enjoys, in particular the statutory right of withdrawal where applicable, as well as the legal guarantees of conformity and against hidden defects.

11. STATUTORY RIGHT OF WITHDRAWAL

For distance sales, the consumer in principle has 14 days from receipt of the product to exercise their right of withdrawal, without having to give any reason. To exercise this right, the customer must send an unambiguous statement to: eleonore.vincere@gmail.com

The customer may also use the model form at the end of these Terms.

After notifying their decision, the customer must return the product within the applicable legal timeframe.

The direct costs of returning the product are borne by the customer, who is informed of this before placing the order.

The product must be properly protected for transport.

The consumer may be held liable for any loss in value of the product resulting from handling other than what is necessary to establish its nature, characteristics and proper functioning.

In the event of a valid withdrawal, the seller will refund the sums due, including the initial standard delivery costs where these must legally be refunded. The refund is made in accordance with the terms and timeframes set out in the French Consumer Code and may be withheld until the product has been received back or until proof of its return shipment has been received.

The fact that a print is signed, numbered, a limited edition or offered for pre-order does not, in itself, remove the statutory right of withdrawal.

The exceptions provided by law remain applicable, in particular for certain goods made to the consumer's specifications or clearly personalised.

12. DAMAGED, DEFECTIVE OR NON-CONFORMING PRODUCTS

The no-commercial-returns policy does not apply to the customer's rights when a product is defective, damaged or does not conform to the order. This practical procedure does not limit any of the consumer's statutory rights.

13. LEGAL GUARANTEES

The seller is liable under the legal guarantees applicable to goods sold to consumers.

Legal guarantee of conformity: the consumer has two years from delivery of the goods to claim under the legal guarantee of conformity when a lack of conformity appears. Under the conditions provided by law, this guarantee may in particular entitle the consumer to have the goods repaired or replaced, free of charge and without major inconvenience.

Guarantee against hidden defects: the consumer also benefits from the legal guarantee against hidden defects provided for in Articles 1641 to 1649 of the French Civil Code. The claim may be brought within two years of discovering the defect, under the conditions provided by law. To exercise these guarantees:

14. INTELLECTUAL PROPERTY

All artworks, creations, photographs, reproductions, texts, videos, graphics, logos and artistic elements presented on vincereart.fr remain protected by the applicable intellectual property rights.

The purchase of an artwork or a physical reproduction does not entail any transfer of the intellectual property rights attached to the artwork. Unless prior written permission is given by the rights holder, the customer is not permitted, in particular, to reproduce, modify, distribute, commercially exploit or create derivative products from the purchased artwork or its visual. The purchase covers only the physical item ordered.

15. PERSONAL DATA

Personal data collected when an order is placed is used in particular to process the order, payment, delivery and customer service, and to comply with the seller's legal obligations. Details of how data is processed are set out in the Privacy Policy available on the website.

16. LIABILITY

The seller cannot be held liable for damage resulting from misuse of the product, incorrect information provided by the customer or an external event reasonably beyond its control, subject to applicable mandatory legal provisions. Nothing in these Terms shall have the effect of limiting or excluding any liability that the law prohibits from being limited or excluded.

17. FORCE MAJEURE

The seller cannot be held liable where a delay or failure to perform results from an event qualifying as force majeure under French law. The customer will be informed as soon as possible when such an event is likely to significantly affect their order.

20. GOVERNING LAW AND DISPUTES

These Terms are governed by French law.
